TCC LCS Programming

Terms and Conditions

TCC Monthly Programming (hereinafter collectively “The Cultivate Code”) and any content therein (defined below) is owned and operated by Mabuhay 3 LLC dba “The Cultivate code”, a Washington Corporation (hereinafter “we” “us” “our” or “The Cultivate Code”). Please read all Terms & Conditions before consenting that you have read these Terms & Conditions, and agree to be bound by them. If you do not agree with this document in its entirety, please refrain from joining The Cultivate Code.

Financial Terms:
Client agrees to The Cultivate Code monthly virtual session will be charged at $119 monthly until cancelled.

Client agrees to The Cultivate Code Monthly virtual and in person will be billed at $169 monthly until cancelled.

Any payment declines from automated payments will be subjected to $20 per declined payment charge and will be added to the outstanding balance of the client.

Cancellations

No refunds are permitted. To cancel your reoccurring monthly payment please cancel 2 weeks in advance.

GENERAL RELEASE OF LIABILITY AND ASSUMPTION OF RISK

I HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING IN THE ACTIVITY AND EVENT, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault. I certify that I am physically fit, have sufficiently prepared or trained for participation in the activity or event, and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation in this activity or event. I certify that I am in good health and that I do not pose a health risk to the public.

In consideration of the services that The Cultivate Code Mentorship Program, their agents, owners, officers, volunteers, participants, employees, and all other persons or entities acting in any capacity on their behalf (hereinafter collectively referred to as "TCC"), I hereby agree to release, indemnify, and discharge TCC, on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative and estate as follows:

I HEREBY WAIVE, RELEASE, AND DISCHARGE TCC and all divisions thereof of any and all liability and responsibility for injuries, sickness, pandemics, accidents, natural disasters and/or acts of God incurred during participation in and/or instruction of camps, private lessons, or any activity I may participate.

I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from this event, THE FOLLOWING ENTITIES OR PERSONS: TCC and their employees, volunteers, or the activity or event holders, activity or event sponsors, activity or event volunteers.

I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in this waiver, release and registration form from any and all liabilities or claims made as a result of participation in this activity or event, whether caused by the negligence of release or otherwise. The accident waiver and release of liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.

I HEREBY UNDERSTAND that participating in The Cultivate Code Mentorship Program DOES NOT GUARENTEE a spot on any dance team, professional or otherwise, or employment of any kind at any company at the time of executing this document and into the future.

USE OF LIKENESS. I grant full permission to TCC to use, without further notification, authorization or compensation to me or anyone on my behalf, my name and likeness, as well as any photographs, audio, videotapes, motion pictures, recordings, or other record of me and/or the Event (or any excerpt thereof) in any and all media, whether now known or hereafter to
become known or developed, worldwide and in perpetuity, and I represent and warrant that no further permission is required for TCC to use such recordings of the Event, my participation therein, or otherwise exercise the rights granted herein.

I CERTIFY THAT I HAVE READ THIS DOCUMENT, AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT OF MY OWN FREE WILL.
